Residential Pool Safety - the Government Grants an Extension until September 2027

The Québec government recently announced that it would push back the deadline for bringing existing residential pools installed before 2010 into compliance with current regulations. Property owners now have until September 30, 2027, to validate the compliance of their installation, obtain a permit and, where required, complete any corrective measures needed to comply with the regulations. 

  

Regulations Already in Force in Pointe-Claire 

 The City of Pointe-Claire points out that its planning by-laws not only comply with provincial requirements but are also more stringent on certain aspects of residential pool safety. This means that compliance with provincial regulations is not enough: residents must also ensure that they comply with current municipal requirements.  

To avoid violations, it is essential to check the provisions of Zoning By-Law PC-2775 before taking any steps. Before undertaking any work, it is essential to always check with the Planning Department whether a permit is required. 

  

Who is Affected by the New Rules? 

All owners of residential pools, whether in-ground, above-ground or demountable, are affected, even those whose installations were previously grandfathered in (i.e. installed before 2010). This “grandfathered clause” has been revoked. 

The regulations apply to everyone, and no minor exemptions can be granted in terms of pool safety.
