Notice to appear from the Commission municipale du Québec

The City of Pointe-Claire has been informed by the Direction des enquêtes et des poursuites en intégrité municipale that the mayor of the City, Mr. Tim Thomas, is facing a municipal ethics hearing in front of the judicial division of the Commission municipale du Québec.
As part of its mission, the Commission municipale du Québec has the mandate to carry out executive functions of control, investigation, monitoring, administration and advisory related to municipal affairs.
In accordance with the Municipal Ethics and Good Conduct Act, when a new Council takes office in a municipality of Québec, the elected officials are required to adopt a Code of Ethics and Good Conduct. The 2021-2025 City Council adopted the Code of Ethics and Good Conduct for elected officials of the City of Pointe-Claire by resolution during its meeting on February 8, 2022.
The Commission municipale du Québec is an organization that holds administrative and judicial authority.
The Commission’s role is to oversee and monitor compliance with the Municipal Ethics and Good Conduct Act and the Codes of Ethics and Good Conduct for elected officials in all Québec municipalities.
If, after an investigation, the Direction des enquêtes et des poursuites en intégrité municipale (DEPIM) of the Commission municipale du Québec considers that the information gathered is liable to demonstrate violations of the Municipal Ethics and Good Conduct Act or the municipal Code of Ethics and Good Conduct, it will issue a notice to appear.
This notice to appear outlines the alleged breaches of ethics. It indicates the sections of the Code of Ethics and Good Conduct that are alleged to have been breached, as well as the time and place surrounding these alleged breaches.
This notice to appear is followed by a hearing in front of the Commission.
In order to not impede on the ongoing proceedings, the City of Pointe-Claire will not comment further on the situation.
